BOYCE HAMLET'S FUND RAISING EFFORTS FOR LEGAL DEFENSE NOT GOING WELL

Tainted ABC Enforcement Director Boyce Hamlet's efforts to raise cash to help defend himself in an illegal exaction lawsuit that seeks to oust him from the position that he lacks experience and qualification to hold and to recover all the funds paid to him as salary for the position that he is unqualified to hold has not raised a dime.

Sources inside the ABC tell us that Hamlet is frequently absent from the office (trying to avoid a process server?) and appears to be red-eyed and depressed.  If we had lied and filed false documents about our employment history to cover up our hiring and firing from the Arkansas State Police in order to gain employment that we would otherwise not be able to obtain by telling the truth, we would be depressed too.

ABC BUSTS VISIONS CABARET - FINDS ROOMS THAT HAVE BEEN USED FOR YEARS AND THAT THE PREVIOUS ABC ADMINISTRATION KNEW ABOUT BUT DID NOTHING

ABC Administration Direct Bud Roberts recently personally conducted an investigation into allegations of violations of ABC rules and policy at Visions Cabaret.  Roberts found evidence of prostitution, indecent sexual conduct and 98 other problems.

Our investigation has determined that the ABC had knowledge of the private rooms at Visions Cabaret and the current ABC Administration is having a showdown with the Enforcement side and it is evidence of the conflict between the ABC Administration section headed by Roberts and the ABC Enforcement section led by tainted ABC Enforcement Director Boyce Hamlet (for now anyways).

An ABC Violation report from August 2008 clearly makes reference to Visions Cabaret having private rooms for the activity commonly known to strip club patrons and the world in general as lapdances.
 

 Another ABC Violation Report from June 2013 also referenced lapdances.

 

Followers of this blog will remember that former ABC Administration Director Mike Langley enjoyed a  little strange every now and then and perhaps he visited the club and did not have issues with the private rooms for private "dances".


Perhaps former ABC Enforcement Agent Jerrell Smith had an arrangement with this establishment like he did with the strip club owned by Billy Marfoglio who gave him a Taser as a "gift".

Whatever happened in the prior ABC Administration, we feel certain that Roberts is trying to do the right thing and deal fairly with permit holders and violations and the fair and consistent application of the ABC rules/policy.

Word is that tainted ABC Enforcement Director is trying to raise cash to pay for an attorney to defend him against an illegal exaction lawsuit that seeks to oust him from his job and recover funds illegally paid to him for a job for which he has extremely little or no qualifications at all to hold (plus he has lied about his employment history to state agencies here in Arkansas and in Mississippi to cover up his hiring and firing by the Arkansas State Police).

We have found some cash for you Boyce, in fact it's some money your wifey apparently forgot about.

We stumbled upon this because an email that we copied Boyce on was bounced back.  We thought he might have been canned last week.

So we looked him up on the Arkansas Government web page to see of he had been removed.  Alas, he had not but we noticed that his wifey's name was also on there.

So we clicked on her name to see what was up and low and behold we found she had some cash escheated away at the state auditor's office (see first photo).

We are certain that the Hamlet's are very thankful that we were able to make them aware of the funds.

ABC ENFORCEMENT DIRECTOR TRYS TO SPIN HIS DEALINGS WITH ETHICS COMMISSION

Tainted ABC Enforcement Director Boyce Hamlet is the subject of an Ethic Complaint because he flat out failed to file a legally required form withing 30 days of being appointed to head the ABC Enforcement Division.

Notice how Boyce lies about it being a technical issue.  What a piece of shit liar he is. But you all knew that didn't you.

There is nothing technical about failing to follow the law, unless Boyce played the "retarded card" again.

Hamlet has proven problems with credibility and honesty and needs to be removed as Enforcement Director to prevent further embarrassment to the ABC and DFA and help these agencies maintain credibility and the respect of the public.

ABC COOPERATING MINOR IN 2008 USED POSITION TO TRY AND EXTORT GOODS & SERVICES FROM MAUMELLE RESTURANTS - WAS FOUND GUILTY OF CRIMINAL VIOLATION

The ABC's controversial and illegal use of minors to try and purchase alcoholic beverages landed on of their illegal operatives, Scott Butler,  in hot water back in the summer of 2008.

Butler was 19 years old at the time and had attended Mills High School when the ABC hired him to break the law and try and purchase alcoholic beverages.

Butler then tried to use his position as an ABC undercover minor to strike a deal with some restaurants in Maumelle.  Butler told these folks if they would give him stuff, he would not "bust" them if they sold him booze in the ABC's entrapment activities at their restaurants.

  

The restaurant owners complained to the Maumelle Police Department and charges were filed against Butler.

Butler was charged under Arkansas Code Annotated  §5-52-106 Soliciting unlawful compensation.

In August 2008, Butler was found guilty in District Court in Maumelle and fined $625.00.

Apparently Butler had some issues as he was selected to participate in the Arkansas National Guard Youth Challenge Program.  The program is for troubled youth.

According to newspaper articles about the incident, the ABC did not have correct information about Butler and could not provide the Maumelle Police Department with very much information about Butler. 

Not much has changed at the ABC, its still a place for out to pasture, tainted law enforcement officers that couldn't get a job anywhere else. 

SCOTT BUTLER - FORMER ABC UNDERCOVER MINOR

 
 
The use of cooperating minors by the ABC to purchase alcoholic beverage violates Arkansas Code Annotated   § 3-3-203, Purchase or possession by minor, which in part states:

"(a) (1) It is unlawful for any person under twenty-one (21) years of age to purchase or have in his or her possession any intoxicating liquor, wine, or beer."

There is no exception to the statue for law enforcement purposes. It might also be argued that parents and/or ABC enforcement agents are violating Arkansas Maltreatment Laws, specifically neglect, by placing these children in potentially dangerous situations and encouraging them and even paying them to break a state law.

A Standford Law Review article says that breaking the law to catch lawbreakers is authorized criminality:

"This practice of authorized criminality is secret, unaccountable, and in conflict with some of the basic premises of democratic policing. And to the extent that authorized criminality presents mixed messages about their moral standing, it undermines social support for the police. While the practice isn’t new, authorized criminality raises fundamental questions about the limits of acceptable police conduct and has been too long ignored…"

The primary rule of statutory construction is to give effect to the intent of the legislature. Snowden v. JRE Invs., Inc., 2010 Ark. 276, 370 S.W. 3d 215. We must construe the statue jest as it reads, giving the words their ordinary and usually accepted meaning in common language. Id.  When the language of a statue is plain and unambiguous and conveys a clear and definite meaning, there is no need to resort to rules of statutory interpretation. Id.  Evans v. Hamby, 2011 Ark. 69, 378 S.W. 3rd 723.

What these means for us non-lawyers, is that Arkansas Code Annotated   § 3-3-203 states that it is illegal for a person under 21 to purchase, try to purchase to possess liquor, wine or beer.  And ABC Enforcement Agents are a party to illegal activity when they use minors to try and entrap permit holders to sell these under age law breakers booze.

It is only a matter of time before a smart permit holder fights back and challenges the ABC's illegal use of undercover minors.
