TAINTED ABC ENFORCEMENT DIRECTOR TAKES CREDIT FOR WORK OF RUSSELLVILE POLICE DEPARTMENT

A haggard, beat-down and baggy-eyed Boyce Hamlet took credit during a KTHV-11 report on Wednesday for actions taken by the Russellville Police Department in connection with an arrest they made of a man selling alcoholic beverage out of his garage.

It's not the first time the ABC has tried to take credit for actions of other law enforcement agencies.

Besides being a cheat and liar, Hamlet can add hypocrite to his resume.

Back in April 2015, Hamlet sent out this email about taking credit for others work...

Boyce is an expert in one thing and that is in being dishonest.

From what ABC administrative staffers tell us (thanks MB for the heads up) if an ABC Enforcement agent just drives by when a local law enforcement agency is making an arrest that in any way involves an alcoholic beverage, even a crumpled up beer can in the bed of a truck, Hamlet writes up a memo and sends it to the governors office and the Director of DFA to claim credit and received some sort of recognition or pat on the back. Can you say insecure?

Hamlet recently told his staff that "the governor likes him" and "he's (Hamlet) not going anywhere", which is a  sure telltale sign that the tainted ABC Enforcement director is under great stress.  Another sign is that he is seldom in the office and no one seems to know where is goes or what he is doing.

Even ABC Administrative Director Bud Roberts is keeping a safe distance from him and quit having an occasional lunch with him.

Hamlet knows his days at the ABC are numbered and time is running out. It's not a matter of will he get fired, its a question of when.

PROSECUTOR HAS DOUBLE STANDARD FOR DEALING WITH BOYCE HAMLET

20th Judicial District Prosecuting Attorney Cody Hiland has a double standard for tainted ABC Enforcement Director and former employee Boyce Hamlet and other law enforcement officers that have issues with telling the honesty and credibility.

In a letter Hiland sent to Mayflower Police Chief Robert Alcon dated Aug. 22, 2014, Prosecuting Attorney Cody Hiland said his office would no longer accept felony case submissions from an officer that had issues with credibility.

“When someone withholds what we consider exculpatory, that’s huge in the prosecutorial world,” the letter reads.

This blog undercovered Boyce Hamlet's attempt to hide and coverup his hiring and firing from the Arkansas State Police for cheating on an exam and then lying multiple times to ASP special investigators.  We also found that Hamlet  provided false information to Hiland when he applied for a job.

Hiland  failed to make the required statutory inquiry to the Arkansas Commission for Law Enforcement Training and Standards to see why Hamlet left employment with previous law enforcement agencies in Arkansas and hired Hamlet, who had documented issues with honesty and credibility.

Law enforcement officers that have issues with credibility and honesty are considered Brady Officers. Prosecutors have a legal obligation to notify criminal defendants about officers that are Brady Officers

Usually classification as a Brady Officer is a death penalty for a career in law enforcement. In Hamlet's case no one seems to give a crap.

So we are suing Halmet and his employer, the Department of Finance and Administration using a little known provision in the Arkansas Constitution.

If our lawsuit is successful, Hamlet will lose his job and have to pay back all funds he has received as salary for a position for which he does not even meet the minimum qualifications. And DFA knew he didn't meet them or sure as hell should have known that he didn't.

Stay tuned for more information.

ABC BOARD AFRAID TO TAKE ACTION AGAINST ERNIE BIGGS

The ABC Board is apparently afraid to enforce the rules and regulations of the ABC and approve the recommendations of ABC Administration Director Bud Roberts and shut down the establishment for two weeks as punishment for violations.

Ernie Biggs has long had a notorious reputation for being a place to score illicit substances and is known as a place where underage individuals can slide right in and purchase alcoholic beverages.

That is exactly the reason Roberts took the actions that he did and ordered them to shut down for two weeks.

In December 29, 2015 employees at Ernie Biggs allowed a minor to enter the establishment and she was served alcoholic beverages.  Later in the evening, her boyfriend was dragged out the front door by another bouncer and tossed like a sack of garbage onto the sidewalk.

In April 2016 board meeting, Roberts said the club should pay a $2,200 fine and not serve alcohol for two weeks for serving a minor and for a bouncer's rough handling of a 21-year-old customer, Brandon Griffin. Specifically, the bouncer, Michael Scott Tice,  was said to have thrown the customer head-first onto a concrete sidewalk "in violation of ABC regulation."

*Hint to the ABC*
Go to the Rivermarket and sit outside Ernie Biggs or Willie D's and you'll see bouncers routinely tossing out patrons just like this.

The club filed an appeal of Roberts' decision and in the hearing held on July 2oth, the attorney for Ernie Biggs was unprepared and the ABC Board, afraid to impose the sanctions against Ernie Biggs, granted a continuance until the November board meeting.

Tice was charged with felony battery on January 12, 2016 and a civil suit has been filed against him by Griffin.

To avoid additional exposure, the club's manager,  Shawn Priebe, fired Tice.

Daniel Bryant, the majority owner of Ernie Biggs told reporters back in April that he was embarrassed that the club had committed multiple ABC violations. Bryant also has his hands in other Rivermarket joints, Big Whiskey's and the Flying Burrito.

Then before the ink could dry on the ABC Violation Report,  another minor was served multiple alcoholic beverages and was involved in a violent altercation that required emergency medical attention.

The ABC Board should have imposed the sanctions against Ernie Biggs.  Perhaps they were under pressure from the Hutchinson Administration to go easy on a supporter or they simply lack the gumption to do their job.

*UPDATE* 07/23/16 - A reader informed us that the former Ernie Biggs bouncer Michael Tice uses an alias, Mike Paige, and has some arrests and cases under that name and that the cases show the name Mike Paige is used as an alias.

ABC BOARD DECISION OVERTURNED BY JUDGE IN ADMINISTRATIVE APPEAL

A 2013 request to move the infamous* Club Hollywood from 4726 Asher Avenue to a remote wooded location at 5719 Penn Loop Road in Hensley was finally resolved in June 2016, when Judge Tim Fox overturned a decision by the ABC Board to deny the club's request to relocate.

Back in March 2013, the club sought to relocate from its long held location on Asher Avenue to a rural location off Woodsen Lateral Road in Pulaski County.

Former ABC Administration Director and outed Ashley Madison dating/cheating website member Michael Langley turned down the club's 2013 request to relocate.

This decision initiated a request for an appeal from long time legal representative Stephen Morley.

The matter was finally heard by the ABC Board on September 16, 2015 and the ABC Board voted to uphold the decision not to permit the club to relocate.

The club filed a Petition for Judicial Review in October 2015 in which they stated the ABC Board made a botched decision on sketchy evidence...

After Judge Tim Fox reviewed the brief's filed by both sides, he made an easy decision.  He overturned the board's decision which permits the clubs relocation.

In the June 2016 ABC Board meeting, the ABC Board made a wise decision not to appeal Judge Fox's decision.

Club Hollywood, like many other outlets that cater to a predominantly non-white clientele, often get a raw deal from the ABC Board.

Congratulations to Club Hollywood for standing up for their rights and not giving up!

* - A man was killed at the club in 2007 when it operated under the name of  The Sandpiper Club.  The club started out as the Malvern Amusement Club in 1968 and has undergone several name changes as well as operating locations since then.

WILL THE ABC FINE OR SHUT DOWN MITCH'S PLACE FOR SERVING A BEER TO A JAIL ESCAPEE?

LOGAN CO. JAIL ESCAPEE SHAUN HIGHAM

Since his arrest for the robbery of the Subiaco Federal Credit Union on June 12, 2015, Shaun Higham of Paris, AR had been a prisoner awaiting trial in the Logan County Jail. That was until June 28th when he and another inmate picked a lock with a toothbrush and escaped at around 4 a.m.

Sheriff Boyd Hicks had  conducted a week long search that included federal, state, county and city law officers and other agencies including the Arkansas Department of Correction, the Office of Emergency Management and Arkansas State Parks. Helicopters and dog teams were brought in to aid in the search.

LOGAN CO. SHERIFF BOYD HICKS

Hicks had concentrated the search for Higham west of Paris along an abandoned railroad bed. There were reports of a break-in of a trailer near the railroad bed and possible sightings over the succeeding days along the railroad bed, each farther west than the preceding report.

Despite bringing in helicopters for aerial searches and dogs to search for tracks or scent, none of the sightings was confirmed.

Searchers had run out of leads, and Hicks said Tuesday that he was meeting with the U.S. Marshals Service and the Arkansas State Police to possibly widen the search on the chance that Higham had left the area to reach family or friends in other parts of the state or in other states.

Sheriff Hicks was surprised when he received a call from Mitch's Place just outside Paris, AR telling him that Higham was at the tavern and wanted to turn himself in.

MITCH'S PLACE

Apparently Higham has a thing for beer joints as he was arrested back in June 2015 hiding out at the Friendly Tavern in Scranton, AR.

When deputies arrived at Mitch's Place they were surprised to find a dirty and disheveled Higham sitting at the bar drinking a beer which had been given to him by the tavern's owner, Mitchell Ford. Deputies did not let Higham finish the beer before taking him back into custody. The beer Highman was drinking was reportedly a Bud Light.

We expect that tainted ABC Enforcement Director Boyce Hamlet will send J.C. Rider and his henchman underling Chris Boyd to investigate the matter.

HAMLET'S DEFENSE FUND IS FLOUNDERING

Tainted ABC Enforcement Director Boyce Hamlet's fund raising efforts for his legal defense fund has raised $0.00 since it was started on June 21st.

Perhaps he should take the hint and resign his position to avoid having to payback more funds should he loose the illegal exaction lawsuit.

WILL ABC BOARD MEMBER JEAN HERVEY BE REPLACED BECAUSE OF HER SUPPORT OF HILLARY CLINTON?

HERVEY CAMPAIGNS FOR HILLARY IN NEW HAMPSHIRE BACK IN FEBRUARY

Long term ABC board member Jean Hervey, who is the record holder for most missed board meetings, is busy trying to get Hillary Clinton elected as the next president.  This is something that does not sit well with Governor Asa Hutchinson and Republicans in his administration and on the ABC board.

Hervey is active in the SEIU, Service Employee International Union which his also a concern to Arkansas Republicans.

Governor Hutchinson would like to get Hervey off the ABC Board if only he could find a suitable replacement.  We offer a black, female, and fellow Republican for his consideration, Princella Smith

PRINCELLA SMITH

Smith, once upon a time worked for Arkansas Secretary of State Mark Martin. She abruptly resigned her position in April 2011 after she was stopped by the Arkansas State Police and ticketed for driving without a vehicle license or insurance and for driving with a suspended driver's license.

Smith also ran, unsuccessfully for Congress that same year.

READ THE ARKANSAS TIMES ARTICLE ABOUT SMITH'S RESIGNATION

Smith seems like the perfect replacement for Hervey on the ABC Board.  Her foibles make her a perfect fit for the ABC with all the other misfits and malcontents.
