ABC ENFORCEMENT DIRECTOR POSES PROBLEM FOR FORMER BOSS

We posted yesterday about a Freedom of Information lawsuit that alleges the Prosecuting Attorney for the 20th Judicial District, Cody Hiland, flat out violated the law no less than five time over a six month period.

It will be interesting to see how the judicial system views a prosecutor that deliberately violated an important state law.

A posting on Hiland's webpage from his failed run for a position on the appellate court is ironical and an utter falsehood.  In other words, a lie.


What could be more important to Hiland than a commitment to the rule of law?  His legacy as a prosecutor.  If the truth comes to light that he had a Brady Officer , none other that tainted ABC Enforcement Director Boyce Hamlet, Jr., working cases for him and he failed to disclose that fact to criminal defendants...well a shitstorm would  develop (Brady Violations).


All the cases that Hamlet Jr. had touched could be subject to a likely reversal of a conviction or a new trial.

That is why Hiland is willing to break the law and chance being charged with a crime.  He want's to keep information about Hamlet, Jr. under wraps.

Word is spreading among criminal defense attorneys about this and its only a matter of time before a lawsuit is filed or a federal agency with the initials F.B.I. begins an investigation.  

We are not the first to blog about Hiland not honoring his stated commitment to following the rule of law. The Blue Hog Report gave a detailed report on several violations of rules/laws that Hiland recently committed. Take a look at what Blue Hog Report posted.

Judgement Day is coming for Hamlet.  There is a lawsuit in the works that will rock the Hutchinson Administration and the Department of Finance and Administration.

ANOTHER FOI LAWSUIT FILED INVOLVING RECORDS RELATED TO ABC ENFORCEMENT DIRECTOR BOYCE HAMLET, JR.

A lawsuit has been filed against Cody Hiland, the 20th Judicial District Prosecuting Attorney and former boss of tainted ABC Enforcement Director Boyce Hamlet, Jr. for his blatant refusal to comply with the Arkansas Freedom of Information Act.

Also named as a co-defendant is Hiland's office administrator, Sirena Moix.

The lawsuit covers five FOI requests made from July 12, 2015 through January 7, 2016 that Hiland refused to provide a response. 

The FOI requests mostly dealt with information relating to or connected with Boyce Hamlet, Jr., a former employee of Hiland.

All of the information requested is releasable under the Arkansas Freedom of Information Act and Hiland has placed himself in a dangerous position by refusing to comply with the law.

Failure to respond to a FOI request can result in criminal charges and jail time

ETHICS COMMISSION SETS DATE FOR HAMLET COMPLAINT



The Arkansas Ethics Commission has set June 17, 2016 as the date they will consider the recently filed complaint about tainted ABC Enforcement Director Boyce Hamlet, Jr. before the Commission.





As the allegations in the complaint are self-evident, Junior will have a difficult time explaining them away.  

We wonder if he will break down and cry like he did during the Arkansas State Police Investigation that he, AG Leslie Rutledge and the Hutchinson administration attempted to keep hidden from the public?

We urge Governor Hutchinson to remove Hamlet as a step to restore the public trust in his administration.

ABC ENFORCEMENT DIRECTOR MAKES FALSE CLAIMS ABOUT VIOLATIONS

Tainted ABC Enforcement Director, Boyce Hamlet, Jr. has added to his list of lies.

In a recent television interview Junior claimed that there had been an increase in violations because of changes he has implemented since his questionable appointment as director.

It's a crock-o-shit as the number of new permits issued have exponentially increased in the last year as Saline County turned wet and new permits issued in NW Arkansas have been steady since three counties there went wet back in 2012.

You can look at data on the ABC webpage and see that each and every month there are new permits being issued.  Increase permits and you expect an increase in violations.  

Our review of their data revealed that from April 2015 through March 2016 approximately 323 new permits were issued by the ABC.

Hamlet may be hampered by his mental condition/learning disability.  If he can't understand algebra formulas you know he can't understand simple statistical relationships.  We wonder how he deals with his department's budget???

Business has been growing so fast in NW Arkansas that there are multiple ABC Enforcement Agents concentrated in that area to handle the workload. Heck just about every Dollar General Store in an Arkansas Wet county has applied for a permit (there are 337 store in Arkansas).

You don't have to be a genius (just have a higher IQ than Hamlet) to understand that as the number of permit holders increase, the number of violations will increase.

When Benton County went wet in 2012 DWI's doubled.  Madison county had a similar increase. One can see how an increase in places that sell alcoholic beverages  can lead to an increase in violations at those establishments.

Hamlet is an embarrassment to the ABC, the Department of Finance & Administration,the Hutchinson administration and the State of Arkansas.

DFA Director Larry Walther needs to follow the example of Education Department Director Johnny Key and get rid of a problem employee.

BREAKING NEWS - ETHICS COMPLAINT FILED AGAINST ABC ENFORCEMENT DIRECTOR BOYCE HAMLET JR.

TAINTED ABC ENFORCEMENT DIRECTOR BOYCE HAMLET, JR.

A complaint has been filed with the Arkansas Ethics Commission concerning violations of Arkansas Law by tainted ABC Enforcement Director Boyce Hamlet, Jr.

Hamlet Jr. is accused of failing to file a required Statement of Financial Interest Form within 30 days of his questionable appointment as ABC Enforcement Director. Additional accusations consist of Junior's failure to disclose his refusal to pay taxes, which is considered by Arkansas Law to be a felony.

Hamlet, Jr.'s refusal to pay his state income taxes resulted in a lien being placed against him by his employer the Department of Finance & Administration.

This is the third complaint in the last two years that has been filed concerning ABC employees. 

Hamlet Jr. is not the first ABC employee to have a lien placed against them for refusing to pay their state income taxes.

The first complaint dealt with the now former Deputy Director of the ABC, Rick Crisman.  Crisman was found to have violated Arkansas Laws by using information obtained in the course of his employment for his own benefit and gain. Crisman was issued a Public Letter of Caution. Apparently the Commission felt that the disgrace to his reputation and forced resignation from the ABC was his dose of Karma.  

The second complaint dealt with the now former ABC Enforcement Agent Jerrell Smith, currently a Pulaski County Sheriff's Deputy.  Smith arranged for an ABC permit holder, William "Billy" Marfoglio, to purchase a Taser for him when he was employed by the ABC as an Enforcement Agent and assigned to monitor Marfoglio's dive bar. The Ethics Commission is still investigating the complaint and if they find probable cause that Smith violated the law, he (and Marfoglio) could be issued a letter of reprimand/caution/warning and be fined $50 to  $2,000  per  violation.

The ABC Enforcement Division has several employees with questionable character and is headed by an individual that a Circuit Court Judge found to lack honesty and integrity which could pose a huge issue in enforcement issues for the ABC.

Governor Hutchinson needs to get rid of Hamlet, Jr. before anymore damage is done to his administration.




ABC ENFORCEMENT DIRECTOR BOYCE HAMLET JR. DISPLAYS HIS HYPOCRISY AND SELF-SERVING ATTITUDE

A recent tweet by tainted ABC Enforcement Director Boyce Hamlet, Jr. expresses how what's good for him is bad for everyone else.





Hamlet Jr. himself was the recipient of a considerable state subsidy.  His college education at the University of Arkansas at Pine Bluff was paid for by the taxpayers.  This was due to his diagnosed mental disability of Dyscalculia. What this means in simple terms is that Junior can't even balance a checkbook much less a department budget.

Hamlet Jr. not only received a subsidized education, he couldn't even meet the basic requirements to graduate and pulled the retarded card to get his degree from prestigious UAPB.



Hamlet Jr. is a dim-witted pussy that is not man enough to take responsibility for his misdeeds and lying. He is such a coward that he won't answer questions put to him by this blog, the Arkansas Democrat-Gazette  and the Arkansas Times.


Junior's days of being unaccountable are numbered. He will not be able to dodge questions for very much longer. Stay tuned.

ABC UPLOADS CORRECT INFORMATION AFTER OUR STORY ABOUT GRIEVOUS ERROR

A week ago we reported a serious error by the ABC that damaged the reputation and impacted the economic situation of two Jonesboro restaurants.

We a happy to report that the ABC has corrected the egregious blunder of elderly and soon to retire (or be fired) ABC employee Karen Blagg.

As we reported, in March 2016 Blagg goofed up and uploaded a five year old report from March 2011 instead of the March 2016 report.

Apparently Blagg must have royally screwed the pooch as you can see by looking at the two images above, the February 2016 report was not listed on their page when we made a screenshot last week, but is there when we made a screenshot this week. Perhaps she actually uploaded the February report on February 24th, but forgot to "publish" it.  

If you click on the report you find that the March 2016 report replaced the 2011 document.

We have previously reported how error-prone Blagg is and she spends quite a bit of time (even at work) posting racist and inappropriate things on her Facebook page.


Perhaps the Arkansas Department of Human Services might look at Bragg if she cares for grandchildren or other relatives children as one of her posts indicates that she might have abusive tendencies.



We suggest that the ABC urge Bragg to retire immediately, as they have other ABC employees, to prevent any further mistakes that would damage the existing poor reputation of the ABC.

ABC EMPLOYEES PREFER PAN PIZZA'S



According to documents we obtained, ABC employees prefer pan pizza style over thin or hand tossed styles.

Supreme is their favorite topping followed by Meat Lovers, Pepperoni Lovers and Hawaiian Luau.





We suspect that the Hawaiian Luau was ordered for ABC Enforcement Agent Kenny Heroman.

ABC DAMAGES TWO N.E. ARKANSAS PERMIT HOLDERS REPUTATION AND CAUSE LOSS IN INCOME BY RELEASING FALSE INFORMATION

On March 18, 2016 the Arkansas Alcoholic Beverage Control agency royally screwed up and posted incorrect information regarding violation reports in mid March.

One of their sharp clerical employees posted a five year old document instead of the current month's violation report.







We believe that ABC employee that posted the old information was Karen Blagg.


BLAGG (ON RIGHT) SPENDS EVERY AVAILABLE MINUTE POSTING CRAP ON FACEBOOK


Blagg is a terrible speller and documents she types often have numerous errors. One attorney for the ABC, Milton Luken, accused her of botching up a transcript in a legal proceeding. I know they are glad she is retiring.

So, on March 21, 2016 Jonesboro television KAIT staff checked the ABC website to see if any area establishments had been found to have violated an ABC rule or regulation.  

According to the document the ABC posted, two popular restaurants,  Kandela Mexican Grill and Fuji Japanese Steakhouse each had been fined $400 and placed on probation for 90 days for serving underage individuals (cooperating underage minors illegally buying booze in violation of Arkansas laws no doubt).

So KAIT posted a story about the two restaurants serving underage individuals and informed viewers that the two establishments could not sell alcoholic beverages for the next 90 days. Can you say "business killer"?

After KAIT ran the story, numerous individuals contacted both restaurants to find out if they were still operating since they couldn't sell booze. After all, who wants a chimichanga without a cerveza or sushi without sake. 

Naturally,  the restaurants complained to KAIT and they "apologized" for their mistake in reporting information that ABC purported to be a correct and accurate report of March 2016 violations.  KAIT then posted a correction.


KAIT HAD TO RUN A RETRACTION AFTER SHIT HIT THE FAN

We contacted both restaurants and were told that they were inundated with calls and social media messages after KAIT ran the erroneous story based on the ABC's bungling mistake. Both reported a loss of business in March which they attribute directly to the ABC publishing the five year old report instead of the correct report.

KAIT news director Josh White told us that "they did not notice the document the ABC had listed as their March 2016 violation report was actually one from March 16, 2011." 

The ABC needs an overhaul.  They have some tainted individuals in positions for which they lack the necessary qualifications, credentials and experience.

ABC ON LIST FOR UNCLAIMED FUNDS

THE ABC MADE THE LIST LAST YEAR

The ABC had unclaimed funds from a credit card account with Citibank and did not know about it until another DFA department sent them an email in November 2015.



Each November 1st of each year, holders with unclaimed property must file a report with the Auditor of State and remit all property outstanding for one to five years on their books as of June 30 of that year. The auditor then has three years in which to attempt to locate the rightful owner before the funds are deposited into the State General Fund where they continue to be held for the benefit of the rightful owner.

As the current ABC main office staff has been there since Moby Dick was a minnow someone must have overpaid a credit card bill for funds to be held by Citibank.  

Hint to ABC staff: You have to review statements and pay attention to what you are doing with public funds.
